Auto-Enrolment Legislative Framework Comes Together

At the start of the month, the DWP made available a raft of documentation and Regulations that help to complete the legislative framework for auto-enrolment, commencing for some employers this year.     These are detailed below, with links to the final version of the Regulations.  We have only offered the briefest of explanations in this Newsletter:

Workplace Pension Reform – Completing the Legislative Framework for Automatic-Enrolment

The Government ran a 12-week consultation from 18 July to 11 October 2011 on workplace pension reform.  This sought views on the changes that needed to be made to secondary legislation and the draft Regulations needed to action this.  These changes were recommended by the Making Automatic Enrolment Work (MAEW) review.

The Automatic Enrolment (Miscellaneous Amendments) Regulations 2012

These Regulations, due to come into force 01 June 2012, amend a large number of previously-defined dates, definitions and administrative requirements under auto-enrolment.

The Occupational and Personal Pension Schemes (Automatic Enrolment) (Amendment) Regulations 2012  

The Regulations, due to come into force 01 June 2012, amend; amongst other things the certification test that may be used to ensure defined contribution schemes meet the necessary quality requirements.  The draft Regulations also contains proposals to exempt some dual-status employees.

The Automatic Enrolment (Offshore Employment) Order 2012

Due to come into force 01 July 2012, this Order extends the provisions of parts of the Pensions Act 2008 to workers inUKterritorial waters and where employment is involved in exploration and exploitation of the seabed and its natural resources.  This order ceases to be effective in July 2020.

The Compromise Agreements (Automatic Enrolment) (Description of Person) Order 2012

Due to come into force 01 July 2012, this Order clarifies the definition of a legal executive as a relevant independent advisor able to give advice in relation to Compromise Agreements under the Pensions Act 2008.
