Our newsletters do not usually feature articles about VAT but that is unavoidable this week, now that HMRC has announced its position on the VAT implications for benefits provided under salary sacrifice schemes – an issue raised by the European Courtdecision in the Astra Zeneca case.
There are have a number of court and tribunal decisions over the years that have been critical of HMRC procedures, but none have come anywhere near the scathing comments of the Tax Tribunal judge in the case that we report this week. The media probably will not pick it up as the situation giving rise to the criticisms does not affect the general public. But it is of real interest to employers who can so easily and unintentionally fail to meet a filing or payment deadline and, some months later, receive an unexpected and costly penalty notice.
