Employer document checks to prevent illegal working

The UK Border Agency, on 2 November 2010, published an updated version of its detailed guidance for employers on preventing illegal working.  A summary version of the guidance has now been published.  Although it lists all of the various documents that employers must examine in order to protect themselves against criminal conviction or civil penalty for employing illegal immigrant workers, it does not provide pictures of the documents.  Both the detailed and summary guidance should be used together.

  1. The above is accurate. Unfortunately, UKBA is under resourced to be of any great assistance to businesses striving to be diligent in conducting document checks.
    As noted, they don’t issue any real guidance for what to look out for. Even if they did, there are so many ways a document can be falsified, that it may even appear genuine to a scanner. Only a trained forgery/counterfeit detection officer can detect a true falsified document. It takes much more than identifying UV features and MRZs.
    I may be plugging my own business here but employers need additional help to really avoid the fines and remain compliant with immigration policy.
