Immigration Rules for Skilled Migrant Workers – New Tier 1 and 2 rules apply from 31 March 2009

Changes to Tier 1 of the points-based system for highly skilled workers, raising the academic and financial requirements of two categories, take effect for all applications submitted on or after 31 March 2009. No employer sponsorship is involved for Tier 1 applications.
Tier 2 however requires employer sponsorship and, also from 31 March 2009, the resident labour market test is strengthened so that an employer wishing to sponsor a migrant worker to do a job under Tier 2 (General) will not pass the test unless the job has been:
- advertised to settled workers in Jobcentre plus, and
- advertised using one other method permitted by the relevant code of practice.
